Vaping is legal in the UAE. Selling electronic cigarettes has been permitted since mid-April 2019, subject to the national standard UAE.S 5030:2018 and mandatory conformity registration. Use is restricted in the same places smoking is restricted, products are capped at 20 mg/ml nicotine, and both devices and liquids carry 100% excise tax.
This guide covers when and how vaping was legalised, what makes a product compliant, where use is restricted, the age rules, the tax position including the September 2027 change, and advertising limits. It states what official sources confirm and is explicit about what they do not.
Is vaping legal in the UAE?
Yes. Electronic cigarettes became legal to sell in the UAE from mid-April 2019, when standards issued by the Emirates Authority for Standardization and Metrology took effect alongside the Emirates Conformity Assessment Scheme, a mandatory certification programme for regulated products. Legality is conditional on compliance, not automatic.
Registration is part of that condition. Products must be registered, and package labelling must also be registered and approved. Importers may additionally need approval from Dubai Municipality’s Health and Safety Department and from health authorities.
This distinction matters more than the headline. “Vaping is legal” describes the category. Whether a specific device or bottle in front of you is legal to sell depends on whether it meets the standard and carries the right markings.
What makes a vape product legal to sell here?
Compliance is defined by UAE.S 5030:2018, “Electronic Nicotine Products (Equivalents of Traditional Tobacco Products).” It governs importing, manufacturing, packing, displaying, trading and labelling. The requirements below can be checked without equipment.
| Requirement | What the standard specifies | Clause |
|---|---|---|
| Nicotine concentration | “Less than or equal to 20 milligrams per millilitre” | 4.2.4 |
| Integrated tank capacity | Shall not exceed 10 ml | 4.2.5 |
| Refill package capacity | Shall not exceed 50 ml per package | 4.2.6 |
| Child resistance | Protective marks and child-resistant mechanisms | 4.1.6 |
| Prohibited ingredients | Vitamins, caffeine, carcinogens, formaldehyde, ammonia, heavy metals, mineral oils | 4.1.11 |
| Health warning | Nicotine addiction warning in Arabic and English | 5.2.8 |
| Age marking | “18+” symbol, minimum 1 cm by 1 cm | 5.2.10 |
| Market marking | “(For sale in the United Arab Emirates)” | 5.2.7 |
| Printed leaflet | Usage, storage, contraindications, addiction and toxicity information | 5.3 |
The 20 mg/ml ceiling applies to every format, including disposable vapes, prefilled pods and bottled e-liquid. It makes no exception for nicotine salts.
Restricted product descriptions
Clause 5.1.2 also limits how products may be described. Prohibited wording includes “light, very light, mild, moderate, natural, organic” and “no additives; no (or very little) flavors,” along with claims of reduced harm, economic advantage over cigarettes, therapeutic benefit, or improved biological performance.
What the standard does not cover
The standard’s scope covers electronic vape products without tobacco and heated tobacco products. It excludes combustible products and oral nicotine products, so nicotine pouches sit outside UAE.S 5030:2018 and are treated separately.
Where can you vape in the UAE?
The Ministry of Health and Prevention stated in 2022 that e-cigarettes are subject to Federal Law No. 15 of 2009 on Tobacco Control. On that basis, restrictions written for smoking apply to vaping, including in offices and closed spaces.
Under Federal Law No. 15 of 2009 and Cabinet Decision No. 24 of 2013:
- Fully smoke-free: hospitals and health facilities, educational institutions including schools, universities and childcare facilities, sports facilities and indoor stadiums, and collective private transport.
- Designated areas permitted, subject to ventilation requirements: shopping centres, restaurants, cultural facilities such as theatres and cinemas, public transport waiting areas, and industrial facilities.
The official UAE government portal additionally lists smoking as banned in houses of worship, closed public spaces, indoor spaces where children are present, and parks, beaches and public recreational areas in Dubai. It also states that smoking is prohibited in private vehicles carrying children under 12.
Venue and emirate rules are frequently stricter than the federal baseline. Read the signage where you are rather than assuming.
On penalties
Specific dirham fine figures for vaping in prohibited places circulate widely online. We have not been able to verify those figures against a Dubai Municipality or Ministry of Health publication, so this page does not state them. Confirm any penalty amount with the relevant authority rather than relying on a retailer or blog summary, including this one.
Age rules
The official UAE government portal states the age of majority for tobacco purchases is 18, and that sellers may request proof of age before sale. Federal Law No. 3 of 2016, known as Wadeema’s Law, forbids selling or attempting to sell tobacco or tobacco products to children.
Clause 5.2.10 of UAE.S 5030:2018 separately requires packs to carry an “18+” symbol stating that sale and consumption is prohibited for individuals under 18.
Retailers may apply a stricter threshold than the legal minimum. This site’s age verification policy requires customers to be at least 21. A shop’s own policy and the federal minimum are two different things, and the stricter one governs at that shop.
Tax on vapes in the UAE
Excise tax has applied to electronic smoking products since 1 December 2019 under Cabinet Decision No. 52 of 2019. Article 2 lists both “electronic smoking device liquids” and “electronic smoking devices and tools” as excise goods, and Article 12 sets the rate for each at 100%, the same rate applied to tobacco products.
A second layer was added in 2027. From 1 September 2027 the Ministry of Finance applies a minimum excise price of AED 1 per millilitre to liquids used in electronic smoking devices. Excise is calculated on the higher of the actual price or that minimum, and the 100% rate is unchanged.
| Element | Position | In force since |
|---|---|---|
| Excise on devices and tools | 100% | 1 December 2019 |
| Excise on liquids | 100% | 1 December 2019 |
| Minimum excise price on liquids | AED 1 per ml | 1 September 2026 |
Because the minimum is volume-based, it affects large, inexpensive bottles most. The Ministry’s published examples put the floor at AED 10 for a 10 ml bottle, AED 30 for 30 ml and AED 60 for 60 ml. A device such as a refillable pod kit is taxed under the device line rather than the per-millilitre minimum.
Advertising and sales restrictions
The official government portal states that tobacco advertising is forbidden, that automatic vending machines for tobacco distribution are prohibited, and that the sale of sweets resembling tobacco products is banned.
UAE.S 5030:2018 adds a packaging restriction. Clause 4.1.14 prohibits packs from containing “printed vouchers, discount offers or a reference to free distribution, two-for-one offers or any other similar offers.”
Bringing a vape into the UAE
Personal import and customs rules are set by customs authorities and are separate from the retail standard covered above. Quantity limits, nicotine strength and pack markings can each be relevant, and duty-free allowances differ from personal import rules.
We have not found an official published statement setting out traveller allowances for electronic nicotine products, so this page does not state one. Confirm the current position with UAE customs before travelling.
Frequently asked questions
Is vaping legal in Dubai in 2027?
Yes. Sale of electronic cigarettes has been legal across the UAE since mid-April 2019, subject to UAE.S 5030:2018 and mandatory conformity registration. Use is restricted in the same places smoking is restricted, which in Dubai includes parks, beaches and public recreational areas according to the official government portal.
What is the legal nicotine limit in the UAE?
20 mg/ml. Clause 4.2.4 of UAE.S 5030:2018 states nicotine content in e-liquid “shall be less than or equal to 20 milligrams per millilitre.” This applies to disposables, prefilled pods and bottled liquid alike, and makes no exception for nicotine salts. Higher strengths sold in other markets exceed the UAE ceiling.
How old do you have to be to buy a vape in the UAE?
The official UAE government portal gives 18 as the age of majority for tobacco purchases, and packs must carry an 18+ symbol under clause 5.2.10. Individual retailers may set a higher minimum as a matter of policy, and where they do, that stricter threshold applies at that retailer.
Can you vape indoors in the UAE?
Generally no. MOHAP has stated e-cigarettes are subject to Federal Law No. 15 of 2009, so indoor smoking restrictions apply. Hospitals, educational institutions and sports facilities are fully smoke-free. Shopping centres, restaurants and cultural venues may operate designated areas subject to ventilation requirements. Individual venues often apply stricter rules.
How much tax is on vapes in the UAE?
Devices and liquids both carry 100% excise, in force since 1 December 2019 under Cabinet Decision No. 52 of 2019. Since 1 September 2026 liquids also carry a minimum excise price of AED 1 per millilitre, with excise calculated on the higher of the actual price or that floor. The 100% rate itself did not change.
Are nicotine pouches covered by the same law?
No. UAE.S 5030:2018 explicitly excludes oral nicotine products from its scope, so nicotine pouches are not governed by the 20 mg/ml e-liquid ceiling or the tank volume limits. They are regulated separately, and conformity requirements for tobacco-free nicotine pouches have been addressed through their own certification route.
What are the fines for vaping in a prohibited place?
Specific dirham amounts circulate widely online, but we have not verified them against an official Dubai Municipality or Ministry of Health publication, so we do not publish figures. Treat any fine amount you read on a retailer site or blog as unconfirmed, and check directly with the relevant authority.
Conclusion
Vaping is legal in the UAE and has been since mid-April 2019, but legality is conditional: a product must meet UAE.S 5030:2018, carry Arabic and English warnings and UAE market marking, and stay within the 20 mg/ml nicotine ceiling. Use follows the same restrictions as smoking under Federal Law No. 15 of 2009, and both devices and liquids carry 100% excise, with an AED 1 per millilitre minimum on liquids since September 2026.
